1. Who you are contracting with

This site is operated by Dr Rumika's ("we", "us", "the house"), a trading name of an Indian private limited company whose full corporate particulars are set out in section 18.

These terms govern both your use of this website and any purchase you make through it. By browsing the site you accept the use terms; by placing an order you additionally accept the sale terms. If you do not accept them, please do not use the site.

2. Who may buy

You must be at least 18 years old and legally capable of entering a contract under the Indian Contract Act 1872, or the equivalent law where you live. If you are between 13 and 18 you may use the site only under the supervision of a parent or guardian who accepts these terms on your behalf.

We do not knowingly sell to anyone under 18, and we do not knowingly collect personal data from children. If you believe a child has given us data, write to our privacy contact and we will delete it.

3. How an order becomes a contract

Nothing on this site is an offer to sell. A product listing is an invitation to treat. Your order is the offer, and no contract exists until we send you a dispatch confirmation for that specific item. An order confirmation email acknowledges receipt; it does not conclude a contract.

We may decline or cancel an order before dispatch, in whole or in part, for any of the reasons below. Where we do, we refund in full to the original payment method and owe nothing further.

  • The item is out of stock, or a one-of-a-kind piece has already sold.
  • The price or description was materially wrong, and the error should reasonably have been obvious to you.
  • We cannot lawfully ship the item to your address, or to your country.
  • We suspect fraud, payment irregularity, or resale in breach of these terms.
  • Your billing and delivery details cannot be verified.

4. Prices, taxes and currency

Prices are shown in the currency selected at checkout and include Indian GST where the order is delivered within India. For orders delivered outside India, prices exclude the destination country's import duty, VAT, customs handling fees and any other charge levied at the border. Those are payable by you as importer of record. See the shipping notice for detail.

Precious metal prices move. We reserve the right to reprice unshipped items where the metal price moves materially between order and dispatch, but only with your express agreement — otherwise we cancel and refund in full rather than charge you more than you agreed.

Obvious pricing errors do not bind us. If an item is listed at a price that is clearly wrong by an order of magnitude, we will contact you and either honour the correct price with your agreement, or cancel and refund.

5. Payment

Payment is taken at checkout, which is hosted and processed by Shopify and the payment gateway we have appointed. We never see or store your full card number. Card data is handled by PCI-DSS compliant processors, and card tokenisation for Indian cards follows the Reserve Bank of India's card-on-file rules.

If a payment is reversed, charged back or fails after dispatch, title in the goods does not pass to you and we may recover them or the sum owed.

6. Title and risk

Risk of loss or damage passes to you on delivery to the address you gave us — not on dispatch. Title passes only when we have received payment in full and cleared funds. Where a carrier loses or damages a parcel in transit, that is our problem to resolve with the carrier, not yours.

7. Product descriptions and images

We describe every item as accurately as we can, and we would rather understate than overstate. Even so, hand-made objects vary. Colour reproduces differently on different screens, natural stones differ from piece to piece, and hand-worked metal carries the marks of being hand-worked. Those variations are a property of the object, not a defect, and are not by themselves grounds for a claim that goods are not as described.

Photographs used for atmosphere and editorial across this site are illustrative. They are not photographs of the specific item you receive unless the page says so. Product photographs are of the item or of a representative example of that run.

8. Cosmetics: what we do and do not claim

Products in the Apothecary are cosmetics. They are not medicines. Nothing sold here is intended to diagnose, treat, cure or prevent any disease or medical condition, and nothing on this site should be read as a medical claim or as a substitute for advice from a qualified clinician.

  • Patch test before first use. Apply a small amount to the inner forearm and wait 24 hours.
  • Read the full ingredient list if you have known allergies or sensitivities. Every ingredient is listed by weight, in descending order.
  • Stop using a product immediately if you experience irritation, and seek medical advice if it persists.
  • Speak to a doctor before use if you are pregnant, breastfeeding, or being treated for a skin condition.
  • Keep out of reach of children, and away from the eyes unless a product says otherwise.

Cosmetics sold into India are regulated under the Drugs and Cosmetics Act 1940 and the Cosmetics Rules 2020, and labelled under the Legal Metrology (Packaged Commodities) Rules 2011. Cosmetics sold into the EU and UK are subject to their own cosmetic product regulations, including responsible-person and notification requirements. Where a product cannot lawfully be sold into your country, we will not ship it there.

9. What you may not do with this site

You may browse, buy, and share links. You may not do any of the following, and we will pursue those who do.

  • Scrape, crawl, harvest or bulk-download any part of the site, its images or its catalogue, by any automated means, except that well-behaved search engine crawlers obeying our robots directives are welcome.
  • Use any content from this site to train, fine-tune or evaluate a machine learning model without our prior written permission.
  • Copy, mirror, frame or republish the site's design, photography, copy or product descriptions.
  • Buy for commercial resale without a written wholesale agreement with us.
  • Interfere with the site's operation, probe it for vulnerabilities without authorisation, or attempt to access another customer's data.
  • Use the site to launder money, to evade sanctions or export controls, or for any unlawful purpose.
  • Impersonate the house, its staff or its artists, or register a domain, handle or trade mark confusingly similar to ours.

We may suspend or terminate access, cancel orders, and report conduct to the authorities where we reasonably believe this section has been breached.

10. Intellectual property

The site, its design, its photography, its written copy, the Dr Rumika's name and marks, and the arrangement of the whole are owned by us or licensed to us, and are protected by copyright, trade mark and design law in India and internationally. Artworks are owned by the artists who made them, and are licensed to us only for the purpose of selling them.

Buying an object transfers the object. It does not transfer copyright, reproduction rights, or any licence to use the artist's work commercially. The Intellectual Property & Takedown notice sets this out in full, along with how to report infringement.

11. Third parties we rely on

Checkout, payment, shipping and email are operated by third parties acting on our instructions. Their failure is not a defence we hide behind — if something we sold you goes wrong, deal with us. But we are not responsible for the content of any third-party site you reach through a link from here.

12. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for anything else that cannot lawfully be limited. Your statutory rights as a consumer are not affected by anything written here.

Subject to that, and to the extent the law allows: we are not liable for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss; and our total liability arising out of any order is limited to the amount you paid for that order.

We do not promise the site will be uninterrupted or error-free, and we may withdraw, suspend or change it without notice.

13. Your rights as a consumer

These terms sit on top of your statutory rights; they never replace them. Depending on where you live, you may have rights that are stronger than anything offered here, and those rights prevail.

  • India — Rights under the Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020, including redress for defective goods, deficient service and unfair trade practice.
  • European Union — A 14-day right of withdrawal from a distance contract under the Consumer Rights Directive, plus a two-year legal guarantee of conformity.
  • United Kingdom — Rights under the Consumer Rights Act 2015 and a 14-day cancellation right under the Consumer Contracts Regulations 2013.
  • Elsewhere — Whatever your local consumer law gives you. Tell us and we will honour it.

14. Complaints and grievance redress

Write to info@bearsystems.in and address it to the Grievance Officer. We acknowledge every complaint within 48 hours and aim to resolve it within one month, as required by the Consumer Protection (E-Commerce) Rules 2020 and the Information Technology Rules 2021.

If you are in India and remain dissatisfied, you may approach the National Consumer Helpline or the appropriate Consumer Disputes Redressal Commission. If you are in the EU, you may use the European Commission's online dispute resolution platform. Nothing here requires you to exhaust our process before exercising a statutory right.

15. Governing law and disputes

These terms are governed by the laws of India. Subject to the paragraph below, the courts at TODO — city whose courts have exclusive jurisdiction have exclusive jurisdiction.

If you are a consumer resident in the European Union, the United Kingdom, or any other place whose law gives you the right to bring proceedings in your own courts and under your own consumer law, that right is unaffected and this clause does not take it away.

16. Changes to these terms

We may change these terms. The version that applies to your order is the version published when you placed it, and we keep dated copies. Where a change materially reduces your rights, we will say so prominently rather than quietly reposting.

17. General

  • If any part of these terms is held unenforceable, the rest continues in force.
  • A delay in enforcing a term is not a waiver of it.
  • You may not assign your rights under these terms; we may assign ours on a sale of the business, without reducing your rights.
  • Nobody other than you and us has any right to enforce these terms.
  • These terms, together with the notices linked from them, are the whole agreement between us about their subject matter.
